Privacy Policy

Orbit Audio, Inc. (“Orbit,” “we,” “us,” or “our”) operates the Orbit mobile application and related services (collectively, the “Service”). This Privacy Policy explains what information we collect, how we use it, and the choices you have. By using the Service, you agree to the practices described in this policy.

1. Information We Collect

Information you provide directly

  • Phone number — collected when you sign in. We send a one-time numeric code via SMS to verify the number belongs to you.

  • Name — collected during onboarding so we can personalize the Service.

  • User content — notes you save, episodes you load, and voice queries you ask the in-app voice agent.

Information collected automatically

  • Voice audio — when you tap the microphone or speak the wake phrase (“Orbit”), short audio clips of your spoken queries are streamed to OpenAI’s Realtime API to generate a response. We do not store raw audio on our servers; audio is processed in transit and discarded after the response is returned. The on-device wake-word detector runs locally and does not transmit audio until you have explicitly triggered the agent.

  • Listening and usage data — the podcasts and episodes you open, playback position, search queries, taps, and screens viewed. Used to operate the Service and improve features.

  • Device and diagnostic data — device model, operating system version, app version, language, time zone, IP address, and crash logs.

  • Identifiers — a user account ID we generate, and (where you grant permission) the Apple-provided device identifier.

2. How We Use Your Information

  • To create and authenticate your account.

  • To deliver core features — loading episodes, transcribing audio, answering voice queries, saving notes, and resuming playback.

  • To send transactional SMS messages required for account verification (see Section 4).

  • To analyze usage, debug crashes, and improve the Service.

  • To detect, prevent, and address fraud, abuse, or security incidents.

  • To comply with legal obligations.

We do not use your information to serve third-party advertising, and we do not sell your personal information.

3. How We Share Your Information

We share information only with service providers that help us operate the Service, and only to the extent necessary. Each provider is contractually limited to using your data on our behalf.

We may also disclose information when required by law (e.g., subpoena, court order), to enforce our Terms of Service, or in connection with a corporate transaction such as a merger or acquisition. If your information would be transferred to a successor entity, we will notify you in advance.

4. SMS Messaging Disclosures

Orbit uses SMS for account verification only. By entering your phone number and tapping “Send code,” you consent to receive a one-time verification code via SMS at the number you provided. You will not receive marketing or promotional SMS messages from Orbit.

  • Program: Orbit account verification (one-time password).

  • Message frequency: One message per sign-in attempt. Codes expire after 10 minutes.

  • Cost: Message and data rates may apply.

  • Opt-out: You may opt out at any time by replying STOP to any message. After opting out you will not be able to sign in using SMS verification.

  • Help: Reply HELP for assistance, or contact us at support@askorbit.to.

  • Carriers: Supported carriers include AT&T, T-Mobile, Verizon Wireless, Sprint, Boost, Cricket, MetroPCS, and U.S. Cellular. Carriers are not liable for delayed or undelivered messages.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All categories of data described in this Privacy Policy exclude text-messaging originator opt-in data and consent; this information will not be shared with any third parties.

5. Data Retention

  • Account data (phone number, name, user ID) — retained while your account is active.

  • Voice audio — not stored on our servers; transcripts of voice queries are retained for up to 30 days for debugging and abuse prevention, then deleted.

  • Notes and listening history — retained until you delete them or close your account.

  • Diagnostic and analytics data — retained in aggregated form for up to 24 months.

If you delete your account, we will delete or de-identify your personal information within 30 days, except where we are required to retain it for legal, accounting, or fraud-prevention purposes.

6. Your Choices and Rights

  • Access and deletion — you may request a copy of your data or ask us to delete your account by emailing support@askorbit.to. In-app account deletion is also available in Settings.

  • Microphone permission — you can revoke microphone access in iOS Settings → Orbit → Microphone. The wake-word feature and voice agent will stop functioning, but the rest of the app continues to work.

  • SMS opt-out — reply STOP to any verification message (note that this disables sign-in).

  • Push notifications — you can disable in iOS Settings → Notifications → Orbit.

California residents (CCPA / CPRA)

If you reside in California, you have the right to (a) know what personal information we collect, use, disclose, or sell; (b) request deletion of your personal information; (c) correct inaccurate personal information; and (d) be free from discrimination for exercising these rights. We do not sell or share your personal information for cross-context behavioral advertising. To exercise any of these rights, email support@askorbit.to. We will verify your request using your phone number on file.

7. Security

We use industry-standard safeguards including TLS encryption in transit, encrypted storage at rest, and role-based access controls. No method of transmission or storage is 100% secure; we cannot guarantee absolute security.

8. Children’s Privacy

The Service is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If we learn that we have collected such information, we will delete it. If you believe a child has provided us with personal information, please contact support@askorbit.to.

9. Changes to This Policy

We may update this Privacy Policy from time to time. Material changes will be communicated through the app or via email to your registered account. The “Last Updated” date above reflects the most recent revision. Your continued use of the Service after an update constitutes acceptance of the revised policy.
